Impact Analysis The fundamental purpose of this project, drafting a Civil Code and a Code of Civil Procedure was not accomplished as of the date of the evaluation. But the project made a meaningful contribution to establishing the drafting bodies and training legal personnel. The translation of the draft into Khmer was almost completed for the eight fields of the Civil Code which was the top priority of the project. Also, by implementing training program in both Cambodia and Japan, the project successfully provided necessary information and trainings.
Effectiveness Ownership/Partnership Evaluation The issue of ownership was not specifically dealt with in the report. When it comes to partnership, according to the report, JICA had a hard time collaborating with Cambodian drafting members because the Department of Justice suffered from a serious shortage of human resources. This resulted in the drafting group being made up of those without appropriate qualifications during the first two years. But, the problem could be resolved after personnel changes within the Department of Justice.

Policy Coherence/Harmonization Evaluation The project had a high relevance. Cambodia lost its administration system for formulation, implementation, monitoring and evaluation of policies as well as basic industrial and social infrastructures after a long conflict. Due to the conflict, Cambodia faced a severe shortage of human resources. Cambodia was in an urgent need for the adequate legal and judicial system. However, the members of the project on the Japanese side faced many problems that could not have been predicted at the planning stage because it was the first experience for JICA to support another country to draft its Civil Code and Code of Civil Procedure. This resulted in progress with frequent adjustments and revisions.

Evaluation Framework Evaluation The evaluation team consisted of 8 experts including lawyers. The period of the evaluation was from 23 February 2002 to 9 March 2002. Results are subdivided into outputs; 1) provide support for making out drafts of the Civil Code, the Code of Civil Procedure and bills associated with the law and codes. 2) provide support for organizational improvement of reforming the courts. 3) provide support for training legal personnel. 4) provide support for reforms of the legal education and for information about law and legal system relating with market economy.

Alignment/Composition of Finance Evaluation The sustainability of the project is fairly questionable. To achieve the overall goals of the project, the continuous support from JICA is still needed in terms of the capacity of the Department of Justice, which is still insufficient in the law-making process and dissemination of the Codes for Cambodia to perform on its own. Also, negotiation with related ministries and other donors was not accurately predicted, along with the time for narrowing the gap in the legal concepts and thinking arising from the social, historical and cultural differences. As a result, further efforts must be made to have the project sustained.
